Family wins $131 million in car accident wrongful death

Last week, Ford Motor Co. settled on  the car accident wrongful death lawsuit filed against them by the family of a New York Mets minor league player killed while driving his Ford Explorer Sport.  Ford agreed to pay $131 million to Brian Cole’s family after 11 out of 12 jurors agreed that Ford was at fault for the tragic car accident.

In March 2001, Cole was driving his Ford Explorer on his way home from spring training when his vehicle veered and rolled off of a Florida highway.  Cole was ejected from the vehicle and suffered serious injuries.  He later passed away at Saint Luke’s Hospital from the injuries incurred in the accident.

Cole’s family argued that physical evidence showed that Cole was wearing his seatbelt at the time of the accident, but it was defective and caused him to be thrown from his car.  Furthermore, they stated that Ford’s vehicle was unstable and did not perform according to how it was marketed.

Midland family to sue driver for wrongful death

47-year olds Marina Lisa Robles and her passenger Joe Luis Ramon were killed on the first day of summer this year when the car they were riding in was hit head-on by another vehicle.  Now, Robles’ family is pursuing a wrongful death case against the driver who struck her vehicle under the belief that he has a “history of alochol and/or drug offenses”.

The defense is arguing that the driver’s record only has a Class B misdemeanor of marijuana possession from 1998.  The driver was jailed  and charged with two counts of intoxication and manslaughter in connection with the accident.  He was released from the Ector County Detention Center on a $50,000 bond.

In the accident, the driver was driving a company vehicle from his job at A-1 FIre and Safety Equipment.  Robles’ family is also suing the company for entrusting him to drive one of their company vehicles.

Trial eminent for manslaughter case

A Waco woman has had her plea bargain refused by a 19th District Court judge in a case of vehicular manslaughter.

The 39-year-old woman, who happens to be legally blind, struck the man on East Lake Shore Drive back in December after not yielding the right of way during a left turn. The man was on his motorcycle, apparently riding to deliver toys to to charity organizations for Christmas. Injuries sustained by the crash killed him. The woman’s child was also injured, as the child was not wearing a seat belt at the time of the accident. She is additionally being charged with injury of a child because of not securing the seat belt while the child was in the car.

Having this plea deal turned down, she is set to appear in court again for an August 17 trial date. According to her defense, they will try to offer another plea bargain on her behalf before that date, and they are certain that a prison sentence would be an unnecessary punishment for this incident.

Man charged in Waco drunk driving case

A man involved in an April 17, 2010 traffic incident that left one dead has been charged with intoxicated manslaughter.

According to the police report, the accused man, a 22 year-old, was driving a Ford F-150 when he turned abruptly in front of another motorist. The other man was driving a Dodge Durango. The accident occurred around 27th Street and Franklin Avenue, happening some time around 2:30 in the morning.

The driver of the Durango was killed at the scene of the crash. The defendant was taken to Hillcrest Hospital after the crash, needing emergency surgery.

Taken in to the McLennan County Jail, the man accused of drunk driving was booked at 11:54 p.m., and then released on bond at $75,000.

1 Killed, 3 Injured in Crash

An 85-year-old Waco man drove through a red light and into another vehicle last week, killing one woman and injuring three others, including two children. She was a passenger. Her children, both 12, were riding in the back of the vehicle. The vehicle’s driver was injured as well.

Police said that all five people involved were taken to Hillcrest Baptist Medical Center, where the mother later died. The 85-year-old man received a ticket for driving through a red light.

Woman Indicted for Manslaughter

A 39-year-old woman was indicted Wednesday for manslaughter for a December accident killing a 45-year-old motorcyclist. The member of Bikers Against Child Abuse was hit and killed while on a Christmas toy run. He was thrown from his motorcycle and taken to Hillcrest Baptist Medical Center, where he died.

The motorist failed to yield at a stoplight. At the scene, in addition to being cited for this, she was also cited for having an unsecured child in a moving vehicle.

Waco Man Killed in Motorcycle Accident

A Waco man has been killed recently in an accident that took place on Sunday.  The man was pronounced dead at the scene of the accident by authorities.

The 25 year-old motorcycle rider was killed after he lost control of the vehicle. The vehicle travelled off road and the rider was ejected and suffered fatal injuries upon impact with the ground.

The man was not wearing a helmet at the time of the accident according to the Department of Public Safety officials. The accident is currently under investigation.

Young Five Year-Old girl Killed in School Accident

A young five year-old girl has recently lost her life following an accident that took place in a gym class. The young girl was crawling around a large cabinet with another student,  when the large cabinet came falling down.  The large and heavy cabinet landed on the young girl,  causing serious immediate injury.

Paramedics were called immediately as the severity of the girl's injuries were apparent.  The girl was rushed to a hospital by the paramedics, but unfortunately the girl was pronounced dead upon arrival.  

The school has stated they will investigate various policies in hopes of preventing an accident like this from happening again.

Three Dead in 5 Vehicle Crash

An accident has been reported Wednesday morning on Interstate 35 near Waco.  The accident is very serious and resulted in three individuals being killed. In total, five vehicles were involved in the accident including a semi-truck, a military Humvee, a garbage truck, a passenger car, and a vehicle towing another vehicle. 

Three drivers were pronounced dead at the scene from the accident. Others involved were rushed to the hospital for treatment.

The accident is currently under investigation.  Several lanes of traffic have been closed down since the accident.  Investigators hope to reconstruct the accident to determine the cause.
