In Connecticut, a family was recently given a record verdict in a cerebral palsy birth injury lawsuit.  The parents of an 8-year old boy with cerebral palsy filed the lawsuit and were awarded $58 million.

The mother of the boy experienced a drop in amniotic fluid on January 31st, 2003, around the time the boy was due to be born.  Doctors did not react to this and failed to order a timely C-section.  A C-section was later performed on February 2nd and the infant suffered hypoxia and brain damage.  As a result, the boy has cerebral palsy and is described as being “profoundly disabled.”

The jury determined that the family should be awarded $50 million for emotional and physical trauma, pain, and suffering and $8 million for the boy’s future medical expenses related to the birth injury.
